Terms of use

Effective and last updated:

Mosey gives you a place to talk things through, reflect, and keep useful ideas from your walks. These terms explain how you can use it and what to expect.

These Terms of use (“Terms”) apply to the Mosey iPhone app, Apple Watch app, widgets, and related features, provided by Darren Tracey in Ireland (“we”, “us”). Contact hello@track.hair and mention Mosey. These Terms apply to Mosey, separately from the Track Hair app.

By using Mosey, you agree to these Terms. Our Privacy policy explains how information is handled.

1. Eligibility and licence

You must be at least 16 years old and legally able to accept these Terms. If local law requires a parent’s or guardian’s permission, you must have it.

The app is licensed to you under Apple’s Standard Licensed Application End User License Agreement (“Standard EULA”). These Terms describe Mosey’s service and supplement that licence; they do not replace the Standard EULA or Apple’s App Store usage rules. If there is a conflict concerning the app licence, the Standard EULA controls, subject always to mandatory consumer law.

You may use Mosey for your personal, lawful use on compatible Apple devices you own or control, as allowed by Apple’s usage rules. We and our licensors retain ownership of the app, its software, design, and branding.

2. What Mosey provides

Mosey can record reflections, transcribe speech, create summaries and follow-ups on your device, save ideas, and provide optional walk reminders and heart-rate prompts. The Watch app can record walks and transfer recordings to your paired iPhone. Features vary with device compatibility, operating system, language, permissions, Apple Intelligence availability, and subscription access.

You do not need a Mosey account. You are responsible for keeping your devices and Apple account secure, reviewing permission choices, and keeping any copies of important information you need. Recordings and transfers can be interrupted by device storage, battery, connectivity, system restrictions, or other technical problems. We cannot recover content that remains only on your devices.

3. Reflection, AI, and health features

Mosey is a personal reflection and wellbeing tool. It does not provide medical care, therapy, diagnosis, treatment, or professional advice, and is not designed as a medical device or emergency monitoring service.

Heart-rate prompts do not establish that you are stressed or unwell. Heart rate can change for many reasons, and Mosey may miss events or show prompts that do not match your experience. No one monitors your recordings or health information on your behalf. If you need urgent help, contact local emergency services or a qualified professional directly.

Speech recognition and AI-generated summaries, suggested actions, and look-backs can be inaccurate, incomplete, or misleading. Review them against your own experience before relying on them, saving a reminder or calendar item, or contacting another person. Do not use them as a substitute for professional medical, mental-health, legal, or financial advice.

Use Mosey safely while walking. Stay aware of traffic, your surroundings, and local rules, and stop somewhere safe before interacting with the screen when needed.

4. Your recordings and other content

You retain your rights in the recordings, transcripts, notes, and other content you create. You permit the app to process that content as needed to perform the features you choose, including transcription, summaries, storage on your devices, and transfers between your paired devices. This does not give us ownership of your content or permission to publish it.

You are responsible for having any permissions or consent required to record other people or include their information. Do not use Mosey to secretly or unlawfully record, harass, impersonate, or infringe another person’s rights.

Do not interfere with the app or its services, attempt unauthorised access, circumvent subscription controls, or copy or reverse-engineer the app except where applicable law or an open-source licence permits it.

5. Mosey Plus, trials, and subscriptions

Some features require Mosey Plus. The App Store purchase screen shows the applicable price, currency, billing period, included features, and any trial or introductory offer before you confirm. Prices and offers may differ by region and eligibility. No trial is promised unless it is displayed for your purchase.

6. Apple services and other apps

Mosey uses Apple system features such as Health, speech processing, Apple Intelligence, notifications, WatchConnectivity, Calendar, Reminders, and contact or message interfaces. Those features may have separate terms, permissions, and availability limits. Apple is not responsible for providing Mosey’s support; contact us for issues with the app.

When you choose to save or send information to another app or person, their services and privacy practices apply. Check the content and destination before confirming. We do not control third-party services or guarantee that they will always be available.

7. Availability, changes, and ending use

We may update Mosey to fix problems, maintain compatibility, improve features, or meet legal requirements. Features can depend on Apple services, model availability, and supported devices. We do not guarantee uninterrupted or error-free operation or that every feature will work on every device.

For a material change that adversely affects a paid service, we will provide notice and any cancellation or other remedies required by applicable law. If we discontinue a paid service, we will honour applicable consumer rights. We may restrict service access for a material breach of these Terms where lawful and proportionate.

You can stop using Mosey at any time. Cancel any subscription separately, then delete unwanted app data and recordings, including recordings waiting on the Watch. Data saved to Apple Health, Calendar, Reminders, messages, or backups must be managed separately. See the Privacy policy for details.

8. Responsibility and consumer rights

We provide Mosey with reasonable care and skill. To the extent permitted by law, we do not promise that AI outputs, transcripts, health prompts, or third-party services will be accurate or always available. You should review generated content and use the app with appropriate care.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable, business losses from personal use of the app, or failures caused by circumstances outside our reasonable control. Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any responsibility that cannot lawfully be excluded or limited. Your mandatory rights concerning digital content, digital services, refunds, and remedies remain in place.

9. Governing law and disputes

Irish law governs these Terms, subject to any mandatory protections in the country where you normally live. You may bring a claim in any court entitled to hear it under applicable consumer law; these Terms do not require you to give up that right. Please contact us first if you would like help resolving an issue.

10. Updates and contact

We may revise these Terms and will update the date above. For material changes, we will give reasonable notice through the app, the App Store, or another appropriate means where required. Changes will not remove rights you already have under mandatory law.
